‘The judgement in Yasin Malik’s case is unacceptable,’ India said on Friday in response to criticism from the Organisation of Islamic Cooperation (OIC).
India has rejected the comments made by the OIC-IPHRC today criticizing its decision on Yasin Malik, according to the Ministry of External Affairs (MEA). OIC-IPHRC implicitly supported Yasin Malik’s terrorist activities, which were documented and presented to the Court by these comments. According to the MEA, there is zero tolerance for terrorism and we urge the OIC to refrain from justifying it in any way.
Yasin Malik was convicted illegally and the charges against him were fabricated in sham trials in India, according to the OIC-IPHRC.
It is a reflection of systemic Indian bias and persecution of Kashmiri Muslims in IOJK that he is imprisoned under inhumane conditions. Innocent Kashmiris are denied their right to self-determination by acts of blatant human rights violations. The travesty not only exposes the claims of democracy, but also constitutes a travesty of Indian justice.
Malik was sentenced to life imprisonment by a Delhi court on Wednesday in a terror funding case, saying that the crimes he committed struck at the “heart of the idea of India” and were intended to forcefully separate Jammu & Kashmir from the Union of India.
The NIA’s plea for capital punishment was rejected by Special Judge Praveen Singh, who awarded varying jail terms to Malik for offences under the draconian anti-terrorism law, the Unlawful Activities Prevention Act (UAPA) and the IPC. As defined by the Supreme Court, life imprisonment means being jailed until the end of time, unless the sentence is commuted by the authorities. The separatist leader was convicted on May 19 of charges that included the death penalty.
Malik told the court on May 10 that he would not contest the charges he was facing, which included Section 16 of the UAPA (terrorist act), Section 17 of the IPC (raising funds for terrorism), Section 18 of the UAPA (conspiracy to commit terrorism), and Section 20 of the IPC (being a member of a terrorist gang or organization).
